Employee Rights and Workplace Protections

If you are dealing with discrimination, a hostile workplace, overtime violations or other workplace issues, and looking for an advocate who can challenge this unlawful activity, amplify your story and/or press your claims in federal and state courts and before administrative agencies such as the Equal Employment Opportunity Commission (“EEOC”) and the Department of Labor (“DOL”), our employment litigation attorneys are here to support you and any of your co-workers subjected to this behavior.

At Spivak Lipton, we’re committed to advocating for YOUR RIGHTS to:

 A Fair Day’s Pay for a Fair Day’s work

  • Equal Pay for Equal Work

  • A Safe, Healthy and Respectful Workplace

  • Freedom from Discrimination, Harassment and Retaliation

  • Paid leave such as Sick, Family, Medical, or Disability Leave

 with OUR STRENGTHS in:

  • Recovering millions of dollars in unpaid minimum wage and overtime pay through litigation in federal and state courts

  • Defending workers from discrimination, harassment and retaliation by filing with government agencies enforcing anti-discrimination statutes (e.g., the EEOC) or filing claims in federal or state court

  • Individualized counseling when filing internal reports and participating in employer investigations

Discrimination complaints: If you are being discriminated against due to your age, race, sex, disability, sexual orientation, national origin, or other characteristic -- including being subjected to a harassing or hostile work environment -- we can advise you on your legal rights and take action against discriminatory practices.

Retaliation: Workers sometimes face retaliation at work for filing complaints or reporting workplace misconduct. This can include transfers, demotions, or termination. If you have experienced such retaliation, we can work to remediate retaliatory acts.

Minimum Wage & Overtime Pay: You have a legal right to proper compensation for your work under the Fair Labor Standards Act (FLSA) and state law. If an employer is withholding overtime payment, paying less than minimum wage, not providing equal pay for equal work, misclassifying you as an independent contractor, depriving you of important employment protections, or paying you less than you deserve in any other way - we can advise you of your rights and take action to recover your wages and other damages.

Leave Time: The Family and Medical Leave Act (FMLA), New York’s Paid Family Leave (PFL) Law and New York’s Paid Sick Leave laws give you the right to take job-protected leave, paid or unpaid, if necessary for specific family or medical reasons. Spivak Lipton can advocate on your behalf if your employer refuses to grant leave requests protected by law and/or retaliates against you for taking leave from work under these circumstances.

Terminations: If you feel you have been unjustly terminated, we can advise you on your legal rights and what options you might have to challenge your termination, either under an existing law or by virtue of an employment agreement or company policy.
